Dominican Republic Moves To Update Laws Governing Regulated Activities: The Ministry of Finance is pushing to create a new agency called the General Directorate of Games of Chance (DGJA). It’s not yet clear if this new body will take over from the current gaming regulator, the Directorate of Casinos and Gambling (DCJA), which has faced its share of problems.

One major issue was a scandal back in May 2021, when a fake lottery draw organized by the National Lottery’s former head led to the theft of about \$8.5 million. This controversy put the existing regulator under a harsh spotlight, raising questions about the need for a fresh start.

DGJA’s Role and Powers

Local media reports say the DGJA will be an independent public agency responsible for overseeing the gaming industry. Its job would include making sure rules are followed, enforcing penalties, and collecting taxes and fees efficiently. The new law would give the DGJA wide powers to control the sector. Besides cracking down on money laundering, it could also punish people or companies that break gambling laws.

Before any penalties are applied, the DGJA’s director general would start a formal investigation. The results of this investigation would then be checked and approved by a Technical Council to ensure fairness.The final approval and enforcement of any penalties would come through a presidential decree.

Leadership and Regulatory Scope

The DGJA’s director general will lead investigations, supported by a team that enforces rules all gambling businesses must follow.

The new law covers online gambling, casinos, sports betting, lotteries, bingo, and raffles, uniting them under one system.

Only hotels with four stars or more can host casinos, which pay taxes based on the number of gaming tables. Slot machines are limited to certain venues and taxed 5% on earnings monthly.

This aims to create a clear, fair, and organized gaming industry.

Geographic Restrictions and Social Impact

The new law sets rules to keep gambling places away from sensitive spots like schools, hospitals, churches, and government offices. Lottery kiosks can’t be closer than 200 meters, while sports betting shops need to stay at least 500 meters away.

This aims to protect vulnerable communities and reduce gambling’s social impact. Breaking these rules could lead to up to 10 years in prison.

Ensuring Fair Play and Security

The DGJA will create guidelines to ensure games are fair, secure, and follow anti-money laundering and consumer protection rules. It will oversee all gambling types, including online, to modernize regulation.

The bill is still new and will be reviewed and updated before becoming final.
